1. Acceptance of Terms
By accessing or using CharityVerify ("the Service"), you agree to these Terms of Service. If you do not agree, do not use the Service. These terms apply to all visitors, users, and subscribers.
2. Description of Service
CharityVerify provides trust scores, risk assessments, and benchmarking data for Canadian registered charities. Our analysis is based on publicly available Canada Revenue Agency (CRA) T3010 filings and related public data sources.
The Service includes a free public website for donors, a paid Data API, and paid change-monitoring products (the "Grantee Watchlist") that alert subscribers to changes in the public record for charities in their portfolio. Features vary by plan.
3. Accounts
- You must provide accurate information when creating an account
- You are responsible for maintaining the security of your account credentials and API keys
- You must notify us immediately of any unauthorized use of your account
- One account per person or organization — duplicate accounts may be terminated
4. Subscriptions and Payment
- Paid plans are billed via Stripe — monthly or annually depending on the plan
- You may cancel your subscription at any time — access continues until the end of the billing period
- Refunds are available within 14 days of initial subscription if you are unsatisfied
- We reserve the right to change pricing with 30 days' notice to existing subscribers
5. API Usage
- API access is subject to rate limits based on your subscription tier
- API keys are confidential — do not share them publicly or embed them in client-side code
- Automated scraping of the website (as opposed to using the API) is prohibited
- We reserve the right to suspend API access for abuse or excessive usage beyond plan limits
6. Charity Claims
Organizations may claim their charity profile on CharityVerify (Org plan). By claiming a profile, you represent that you are authorized to act on behalf of that charity. We verify claims via email to the charity's registered address. Fraudulent claims will result in immediate account termination.
7. Data Accuracy and Disclaimers
- Trust scores and analyses are based on publicly available CRA data and our proprietary algorithms
- Scores are informational and should not be the sole basis for donation decisions
- We make reasonable efforts to ensure accuracy but do not guarantee that all data is error-free
- CharityVerify is not affiliated with or endorsed by the Canada Revenue Agency or the Government of Canada
Monitoring & Alerts
- Watchlist alerts and digests report observable changes in the public record. They are informational, not a compliance control — they do not constitute legal, financial, accounting, or AML/ATF advice, and do not replace your own due-diligence, legal review, or (for regulated entities) your anti-money-laundering program.
- Detection depends on when changes appear in CRA's public record and on our refresh cadence. We do not guarantee that any change will be detected, or detected within any particular time.
- Alert history and timestamps are provided as a record of what CharityVerify observed and when — not as evidence of a charity's actual status at any moment.
- Grant, disbursement, and compliance decisions remain solely your responsibility.
8. Intellectual Property
The CharityVerify name, logo, scoring methodology, and website design are our intellectual property. You may not copy, reproduce, or redistribute our trust scores, analyses, or content without permission, except as permitted through our API for authorized use cases.
Charities that claim their profile may embed our trust badge on their own website as permitted.
9. Prohibited Uses
- Using the Service to defame, harass, or harm any charity or individual
- Attempting to manipulate trust scores or game the scoring system
- Reselling access to our data or API without a commercial agreement
- Interfering with the operation of the Service or its infrastructure
10. Limitation of Liability
CharityVerify is provided "as is" without warranty of any kind. To the maximum extent permitted by law, we shall not be liable for any indirect, incidental, or consequential damages arising from your use of the Service. Our total liability shall not exceed the amount you paid us in the 12 months preceding the claim.
11. Termination
We may suspend or terminate your account for violation of these terms. You may close your account at any time. Upon termination, your right to use the Service ceases immediately, though provisions regarding liability, intellectual property, and disputes survive.
12. Governing Law
These terms are governed by the laws of the Province of Alberta, Canada. Any disputes shall be resolved in the courts of Calgary, Alberta.
13. Changes to Terms
We may modify these terms at any time. Material changes will be communicated to registered users via email with 30 days' notice. Continued use after changes take effect constitutes acceptance.
